关于乡村法治和德治体系建设研究
摘 要
乡村治理是社会治理的重要组成部分，乡村治理现代化是构建国家治理体系现代化的应有之义。面对新时代乡村治理出现的“复合型危机”、基层治理薄弱、治理主体缺失、治理主体参与积极性和效果不良等现象，党的十九大报告提出建立法治、德治相结合的乡村治理体系，实现”共建、共治、共享”的社会治理格局。
本文以对其在乡村治理体系建设过程中取得的一定成效进行梳理的基础上，通过对其乡村治理体系建设中存在的党建引导还需加强；村民自治需要完善；法治建设相对滞后；德治基础面临挑战等四个方面问题的剖析，认为这些问题的存在与其自身经济发展相对滞后、传统思想仍有影响、农村人口流动性大等原因密切相关，当然还有法律法规有待完善的因素。因此，遵循发现问题，分析原因，借鉴经验的思路，本文以坚持党的领导，健全法治保障，树立乡村法治理念；深化德治支撑，营造乡村德治氛围；实现法治、德治的乡村治理体系的完善路径。希望这些对策建议，能够对乡村治理体系的完善起到积极的推动作用，提升乡村治理效能，促进实现乡村治理体系和治理能力的现代化。

Abstract
Rural governance is an important part of social governance, and the modernization of rural governance is the proper meaning of constructing the modernization of national governance system. In the face of the "complex crisis" of rural governance in the new era, the weak governance at the grass-roots level, the lack of governance main body of governance, the enthusiasm and poor effect of the participation of the main body of governance, the report of the Nineteenth National Congress of the Communist Party of China proposed the establishment of a rural governance system combining the rule of law and rule by virtue to realize the social governance pattern of "co-construction, co-governance and sharing ".
On the basis of combing some achievements in the construction of rural governance system, this paper needs to strengthen the guidance of the Party building in the construction of rural governance system； the villagers' autonomy needs to be improved； the rule of law construction is lagging behind； the foundation of rule by virtue is facing challenges. Therefore, following the idea of finding problems, analyzing reasons and drawing lessons from experience, this paper aims at adhering to the leadership of the Party, perfecting the guarantee of the rule of law, setting up the concept of rural rule of law； deepening the support of rule by virtue and creating the atmosphere of rural rule by virtue； and realizing the perfect path of the rural governance system of rule by law and rule by virtue. It is hoped that these countermeasures and suggestions can play a positive role in promoting the improvement of rural governance system, improving the efficiency of rural governance, and promoting the modernization of rural governance system and governance ability.
